Abstract:   (879 Views)
Cosmetic surgery is one of the emerging topics in medical knowledge, which has expanded due to the advancement of surgical expertise. The present library research described and analyzed legal jurisprudence propositions and demonstrated that due to the novelty of the subject of the wife's cosmetic surgery in jurisprudence and law, there is no explicit text on the husband's permission or lack of permission. Therefore, this topic can be explored in jurisprudence and law under the title of the husband's authority over the wife. It seems that the husband's permission is not an absolute condition for performing cosmetic surgery; instead, the husband's permission is a criterion to the extent that it does not conflict with conjugal rights (right to enjoyment). According to the element of durability in cosmetic surgery, when the religious rights of the couple are harmed as a result of cosmetic surgery, according to the theory of dowry against sexual abuse, the couple can reduce the dowry in the event of divorce or in case of moral damage, demand compensation for moral damage caused by the effect of cosmetic surgery.
