fa حقوق بیمار و پزشک در مسائل درمانی بر روی هوش مصنوعی و فناوری های نوین پزشکی فقه و حقوق اسلامی Islamic Feqh & Law پژوهشي - مقاله اصیل Original Research <p dir="RTL" style="text-align:right"><span style="font-size:11pt"><span style="font-family:Calibri,sans-serif"><span style="font-family:&quot;B Nazanin&quot;">تحولات گسترده در حوزه هوش مصنوعی و فناوری‌های نوین پزشکی، موجب دگرگونی‌های بنیادینی در فرآیندهای درمانی و تعاملات میان پزشک و بیمار شده‌اند. این فناوری‌ها با ایجاد بسترهای نوین تشخیص، درمان و مراقبت، همزمان پرسش‌هایی اساسی را در باب حقوق، مسئولیت‌ها و حدود اختیارات طرفین درمان مطرح می‌سازند. در این میان، نظام‌های فقهی و اخلاقی اسلامی، به‌ویژه فقه شیعه، نیازمند بازنگری و تطبیق با این پیشرفت‌ها هستند تا بتوانند پاسخ‌گوی مسائل نوظهور باشند. هدف از این پژوهش، بررسی و تحلیل حقوق بیمار و پزشک در بستر به‌کارگیری هوش مصنوعی و فناوری‌های نوین پزشکی از منظر اسلامی و بین‌المللی است</span>.</span></span></p> <p dir="RTL" style="text-align:right"><span style="font-size:11pt"><span style="font-family:Calibri,sans-serif"><span style="font-family:&quot;B Nazanin&quot;">این تحقیق به شیوه توصیفی-تحلیلی و با بهره‌گیری از منابع کتابخانه‌ای انجام شده است. منابع فقهی معتبر شیعه، اسناد بین‌المللی حقوق بشر در حوزه سلامت، و متون تخصصی مرتبط با فناوری‌های نوین پزشکی بررسی و تحلیل شده‌اند. روش تحلیل داده‌ها کیفی بوده و تلاش شده تا با تطبیق مفاهیم سنتی با فناوری‌های جدید، الگوی نوینی از حقوق و وظایف پزشک و بیمار ارائه شود</span>.</span></span></p> <p dir="RTL" style="text-align:right"><span style="font-size:11pt"><span style="font-family:Calibri,sans-serif"><span style="font-family:&quot;B Nazanin&quot;">یافته‌های پژوهش نشان می‌دهد که اگرچه هوش مصنوعی می‌تواند نقش چشمگیری در ارتقای خدمات پزشکی داشته باشد، اما چالش‌هایی نظیر شفافیت در تصمیم‌گیری، مسئولیت حقوقی ناشی از خطاهای سیستم، حفظ کرامت انسانی بیمار و رعایت رضایت آگاهانه، ضرورت بازنگری در مبانی فقهی و قانونی را دوچندان می‌کند. همچنین مشخص شد که در بسیاری از موارد، ضوابط موجود پاسخ‌گوی شرایط نوین درمانی نیستند</span>.</span></span></p> <p dir="RTL" style="text-align:justify"><span style="font-size:11pt"><span style="font-family:Calibri,sans-serif"><span style="font-family:&quot;B Nazanin&quot;">هوش مصنوعی در پزشکی فرصتی بزرگ برای بهبود کیفیت درمان است، اما بدون تبیین دقیق حقوق و تکالیف بیمار و پزشک، می‌تواند زمینه‌ساز تضییع حقوق گردد. تدوین چارچوب‌های حقوقی و فقهی مبتنی بر مبانی اسلامی و هم‌راستا با استانداردهای جهانی، ضرورتی اجتناب‌ناپذیر است.</span></span></span></p> <p><span style="font-size:11pt"><span style="font-family:Calibri,sans-serif">The rapid advancements in artificial intelligence (AI) and emerging medical technologies have brought about fundamental transformations in diagnostic, therapeutic, and care processes, reshaping the interactions between physicians and patients. While these technologies offer numerous benefits, they also raise critical questions regarding the rights, responsibilities, and limits of authority for both parties involved in treatment. In this context, Islamic legal and ethical systems, particularly Shi&#39;a jurisprudence, require adaptation and reevaluation to address these emerging challenges. This study aims to examine and analyze the rights of patients and physicians in the context of AI and modern medical technologies from both Islamic and international legal perspectives.</span></span></p> <p><span style="font-size:11pt"><span style="font-family:Calibri,sans-serif"><strong>Methodology:</strong></span></span></p> <p><span style="font-size:11pt"><span style="font-family:Calibri,sans-serif">This research employs a descriptive-analytical method based on library resources. Key Shi&#39;a jurisprudential texts, international human rights documents related to health, and specialized literature on modern medical technologies were reviewed and analyzed. A qualitative approach was used to align traditional legal concepts with contemporary technological developments, seeking to provide a modern framework of rights and responsibilities for physicians and patients.</span></span></p> <p><span style="font-size:11pt"><span style="font-family:Calibri,sans-serif"><strong>Findings:</strong></span></span></p> <p><span style="font-size:11pt"><span style="font-family:Calibri,sans-serif">The findings reveal that while AI can significantly enhance medical services, it also presents challenges such as transparency in decision-making, legal accountability for system errors, preservation of patient dignity, and the enforcement of informed consent. These issues underscore the urgent need to revise and expand existing legal and ethical foundations. It was also found that current regulations often fall short in addressing the complexities introduced by modern medical practices.</span></span></p> <p><span style="font-size:11pt"><span style="font-family:Calibri,sans-serif"><strong>Conclusion:</strong></span></span></p> <p><span style="font-size:11pt"><span style="font-family:Calibri,sans-serif">Artificial intelligence in medicine offers a major opportunity for improving the quality of healthcare; however, without clearly defined rights and obligations for both patients and physicians, it may lead to the violation of fundamental rights.
