fa مسئولیت های مدنی و کیفری بیماری روانی پارافیلیک از دیدگاه فقه و حقوق اسلامی Civil and Criminal Responsibilities of Paraphilic Mental Illness Patients from the Perspective of Islamic Jurisprudence and Law پزشکي قانوني پزشکي قانوني پژوهشي - مقاله اصیل Original Research <div style="text-align: justify;">بیماری پارافیلیک گونه‌ای بیماری روحی و روانی است که فرد بیمار در حین رابطه جنسی، دچار هیجان شدید می‌شود و ممکن است خسارات جانی و مالی به بار آورد. اصل بر این است که آسیب رساندن به جان و مال دیگری، مستوجب مسئولیت‌های حقوقی باشد. بررسی حقوقی این مسئله اهمیت دارد. نظام‌های قضائی دراین‌باره سختگیری شدیدی دارند و رویه قضائی چنین نشان داده است که بر این مسئله شدت عمل دارد. این پژوهش به روش تحلیلی‌توصیفی انجام شده است و محقق سعی در بررسی مسئولیت‌های حقوقی این بیماری از دیدگاه فقه و حقوق اسلامی دارد. نتیجه اینکه، امکان آسیب جانی به بیمار وجود دارد و تخلیه هیجانات توسط وی، یک ضرورت محسوب می‌شود. بنابراین، چنین حرکاتی به‌صورت غیرارادی انجام، و عنصر مادی جرم مخدوش میشود. به همین علت، نمی‌توان مسئولیت کیفری برای بیمار در نظر گرفت؛ اما مسئولیت مدنی به قوّت خود باقی است؛ چراکه در ادبیات حقوق مدنی، اثر سوءنیت تعریف ‌نشده است. فقهای اسلامی به‌صورت یک‌صدا اعمال مجازات برای این بیماران را ضروری می‌دانند. بااین‌حال، حقوق‌دانان کیفری هنوز به این مسئله توجهی نداشته‌اند و علت امر، فقدان بررسی تخصصی مسئولیت کیفری است. نیاز است به‌صراحت مسئولیت کیفری این بیماران رفع شود و شرایط آن نیز تصریح یابد. </div> <div style="text-align: justify;">Paraphilic illness is considered a mental and psychological illness in which the patient experiences intense excitement during sexual intercourse, which may cause physical and financial losses. The principle is that harm to the life and property of another person is subject to legal responsibilities; therefore, legal examination of this issue is essential. Judicial systems are rigorous in this regard, and practice has shown strict adherence to this issue. This research employed an analytical-descriptive method, and the researchers aimed to examine the legal responsibilities of the disease mentioned above from the perspective of Islamic jurisprudence and law. The results showed that there is a possibility of physical harm to the patient, and their emotional discharge is considered necessary. Therefore, such movements are performed involuntarily, and the material element of the crime is distorted. For this reason, criminal liability cannot be considered for the patient. However, civil liability remains in force, since the effect of malicious intent has not been defined in the literature of civil law. Islamic jurists unanimously consider it necessary to punish these patients. Criminal lawyers have not yet paid attention to this issue due to the lack of specialized examination of criminal liability. It is necessary to explicitly eliminate the criminal liability of these patients and clarify the conditions under which it applies.</div> مسئولیت مدنی, مسئولیت کیفری, عنصر اراده, بیماری پارافیلیک, حقوق اسلامی.
